What Are You Entitled To In Your Divorce?
Arkansas law tries to achieve equity in the property settlement. This includes all money and assets acquired during the marriage as well as an equal share of the marital debt. In some cases, exceptions can be granted if one party has squandered assets through gambling, drug use or other destructive behaviors.
The basic standard is a 50-50 split of everything. Assets and debts in the marital estate can include but are not limited to the following:
- Retirement accounts
- Bank accounts
- Investment accounts
- Vehicles
- Real estate
- Credit card bills
- Miscellaneous debt
Depending on the circumstances, some property, such as an inheritance, may not be considered to be part of the marital estate to be split.
What If There Is No Agreement?
If no agreement can be reached by the divorcing parties, the court has the authority to order a sale of all assets, with the proceeds being split 50-50 after all marital debt is paid. This is rare in some counties, but common in others.
